1. Agreement to These Terms

By accessing or using this website, creating an account, submitting a rental request, placing an order, or accepting equipment from Ditch Magnet Rentals (“DMR,” “we,” “us,” or “our”), you agree to these Terms & Conditions and any additional rental terms, order details, quotes, invoices, or agreements applicable to your transaction.

Where a separate written rental agreement or transaction-specific document conflicts with these general website Terms, the transaction-specific agreement controls with respect to that rental.

2. Eligibility and Authority

You must be at least 18 years old and legally able to enter into a binding agreement to rent equipment from DMR. If you act for a company or other organization, you represent that you are authorized to bind that organization to the applicable rental and payment obligations.

3. Accounts

You are responsible for providing accurate and current account information and for safeguarding your login credentials. Contact us promptly if you suspect unauthorized account access.

4. Rental Orders and Availability

Rental requests and website submissions are subject to equipment availability and DMR's acceptance. Display of equipment on the website does not guarantee availability for a particular date, location, or rental period.

Rental dates, rates, quantities, delivery or pickup arrangements, deposits, and other transaction details may be confirmed through checkout, an order confirmation, quote, invoice, or separate rental agreement.

5. Pricing, Payments, Deposits, and Authorizations

You agree to pay all rental charges, approved delivery or shipping charges, taxes, fees, late charges, damage or loss charges, and other amounts applicable to your transaction.

DMR may require a security deposit and/or payment-card authorization or hold before releasing or shipping equipment. Payments may be processed by third-party payment processors.

6. Cancellation and Refunds

Unless different terms are stated for a particular rental, a customer may cancel an eligible rental for a refund before the equipment has shipped, been dispatched for delivery, been picked up, or the rental period has begun, as applicable.

Once equipment has shipped or been dispatched, has been picked up by the customer, or the rental period has begun, rental charges are generally non-refundable. Shipping, freight, delivery, and other costs already incurred may also be non-refundable.

7. Equipment Possession and Care

From the time equipment is delivered, picked up, or otherwise placed in your possession or control until it is returned to and accepted by DMR, you are responsible for reasonable care, custody, security, and lawful use of the equipment.

8. Loss, Theft, Damage, and Abnormal Wear

The customer is financially responsible for rented equipment that is lost, stolen, destroyed, damaged, or subjected to abnormal or excessive wear while in the customer's possession or control, except to the extent otherwise stated in a written rental agreement or required by law.

DMR may charge reasonable amounts associated with inspection, cleaning beyond ordinary return condition, repair, replacement, recovery, or other customer-responsible loss.

9. Rental Period and Late Returns

Equipment must be returned by the agreed return date. Equipment retained beyond the agreed rental period may continue to accrue rental charges and may be subject to additional late or extension charges until returned and accepted by DMR. Extensions require DMR approval.

10. Shipping, Delivery, Pickup, and Returns

DMR serves customers within the United States. Equipment may be shipped by UPS, FedEx, LTL or other freight service, delivered locally, or picked up by the customer.

DMR does not automatically provide prepaid return shipping. Return transportation may be arranged by DMR when agreed, arranged by the customer, or completed through an approved customer drop-off. See our Shipping & Returns Policy.

11. Inspection and Return Condition

Returned equipment may be inspected by DMR. Return of equipment does not waive amounts that may be due for late return, loss, damage, abnormal wear, cleaning, missing components, shipping, or other authorized charges.

12. Website Information

We work to keep website descriptions, availability, specifications, and other information accurate, but website content may contain errors or become outdated. Transaction-specific information confirmed by DMR should be used for your actual rental.

13. Prohibited Website Use

You may not misuse the website, attempt unauthorized access, interfere with website security or operation, submit fraudulent information, or use the website in violation of applicable law.

14. Intellectual Property

Unless otherwise indicated, the Ditch Magnet Rentals name, website design, original text, graphics, logos, and other original website materials are owned by or licensed to DMR and may not be commercially used without authorization, except as permitted by law.

15. Disclaimers

To the extent permitted by law, the website is provided on an “as is” and “as available” basis. Nothing on the website replaces job-specific safety procedures, professional judgment, manufacturer instructions, or the customer's responsibility to determine whether equipment is appropriate for its intended use.

16. Limitation of Liability

To the fullest extent permitted by applicable law, DMR will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of or inability to use the website. Liability relating to rented equipment or rental services may also be governed by the applicable rental agreement.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

17. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when this version was last revised.
